When buying a property, be sure to check the property certificate (sheet nepokretnosti), whether it has a mark "Nema gradzevinske dozvole", i.e. there is no building permit.
Compare the cadastral plan with the actual state of the property. If there are encumbrances or unapproved additions, it is necessary to go through the process of legalization of the property.
Legalization of construction objects has been carried out in Montenegro since 2018 on the basis of the "Law on Regularization of Informal Objects". In order to remove a self-built building from the shadow, it is necessary to submit an application, collect a package of documents and pay a tax for connection to the city utilities.
At the moment, the legalization process is declared open-ended, as the authorities need a lot of time to process applications for legalization. But only houses built before 2018 and marked on orthophotos can be removed from the shadow. Objects built after the deadline cannot be legalized.
