How to buy
a legal house in Montenegro
ㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤTens of thousands of properties in Montenegro do not have building permits. At the same time, they are quietly rented out, sold and bought. How not to get caught in "lawless" real estate and what to do if you have already bought such housing.
Tens of thousands of properties in Montenegro do not have building permits. At the same time, they are quietly rented out, sold and bought. How not to get caught in "lawless" real estate and what to do if you have already bought such housing.
(1)
When buying a property, be sure to check the property certificate (sheet nepokretnosti), whether it has a mark "Nema gradzevinske dozvole", i.e. there is no building permit.
(2)
Compare the cadastral plan with the actual state of the property. If there are encumbrances or unapproved additions, it is necessary to go through the process of legalization of the property.
Legalization of construction objects has been carried out in Montenegro since 2018 on the basis of the "Law on Regularization of Informal Objects". In order to remove a self-built building from the shadow, it is necessary to submit an application, collect a package of documents and pay a tax for connection to the city utilities.
At the moment, the legalization process is declared open-ended, as the authorities need a lot of time to process applications for legalization. But only houses built before 2018 and marked on orthophotos can be removed from the shadow. Objects built after the deadline cannot be legalized.
(3)
It is necessary to find out from the owner whether he has applied for legalization before 2018. If yes, the process will simply continue with the new owner — when the authorities process the application, he will pay the tax and the encumbrance will be removed.
(4)
If an application has not even been submitted, it is necessary to find out whether it is possible to legalize the acquired real estate in principle. For example, it is impossible to legalize objects located in national parks, in the protective strip of roads, in the landslide zone, at a distance of less than 400 meters from military facilities.
ㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤㅤ Currently, the law does not provide for the demolition of illegal houses — only fines, but the sanctions may be tightened. And it will be more and more difficult to sell such houses in the future. In order not to be left alone with the legalization process, full of pitfalls, it is better to turn to specialists who will check all the risks of the purchased property.
